Özet (bağlayıcı metin aşağıdadır): FORMA ücretsiz bir antrenman takip uygulamasıdır; sağlık hizmeti değildir. Programlar önceden hazırlanmış genel önerilerdir; uygulama sorumluluğu sana aittir (Sağlık ve Sorumluluk Bilgilendirmesi). Hesap yoktur, verilerin cihazında kalır. Tüketici olarak kanundan doğan hakların saklıdır.

1. Taraflar ve kabul

Bu Kullanım Koşulları (“Koşullar”), FORMA iPhone ve Apple Watch uygulamaları ile ilgili web sayfaları (birlikte “Uygulama”) hakkında Mehmet Mutlu (bireysel geliştirici, Üsküdar / İstanbul; “FORMA”, “biz”) ile Uygulamayı kullanan kişi (“sen”) arasındaki sözleşmedir. İletişim: apps.support.mm@gmail.com.

Uygulamayı ilk açtığında bu Koşulları ve bunların ayrılmaz parçası olan Sağlık ve Sorumluluk Bilgilendirmesi'ni kabul etmen istenir; kabul etmeden Uygulama kullanılamaz. Kabulünün tarihi ve metin sürümü yalnızca cihazında saklanır. Gizlilik uygulamalarımız Gizlilik Politikası'nda anlatılır.

3. Ücret

Uygulama şu anda ücretsizdir; reklam, abonelik veya uygulama içi satın alma içermez. İleride ücretli bir özellik eklenirse, bu ancak bu Koşullar güncellenerek ve satın almadan önce açıkça bilgi verilerek yapılır; mevcut ücretsiz özellikler için geriye dönük ücret alınmaz.

4. Kimler kullanabilir

Uygulama 14 yaş ve üzeri içindir. 18 yaşından küçüksen Uygulamayı yalnızca velinin veya yasal temsilcinin onayıyla ve gözetiminde kullanabilirsin.

6. Kabul edilebilir kullanım

Uygulamayı yalnızca yasal ve kişisel amaçlarla kullanabilirsin. Uygulamayı tersine mühendislik, kaynak kodunu çıkarma, değiştirme, güvenlik önlemlerini aşma, içeriğini (figürler, animasyonlar, programlar, hareket metinleri) toplu olarak kopyalama veya ticari amaçla dağıtma girişiminde bulunamazsın; ancak kanunun emredici olarak izin verdiği haller saklıdır.

7. Verilerin

Uygulamaya girdiğin veriler sana aittir ve yalnızca cihazında saklanır. Elimizde kopya bulunmadığından verilerinin yedeklenmesinden (iCloud yedeği veya dışa aktarılan dosya) sen sorumlusun; cihaz kaybı, uygulamanın silinmesi ya da Verilerimi sil sonrası verileri geri getiremeyiz.

8. Apple Sağlık ve Apple Watch

Apple Sağlık entegrasyonu yalnızca iznin varsa çalışır ve Apple'ın koşullarına tabidir. Adım, mesafe, kalori ve nabız gibi değerler cihaz ölçümü ya da tahmindir; tıbbi amaçla kullanılmamalıdır.

Yürürlükteki mevzuatın izin verdiği en geniş ölçüde Uygulama ücretsiz olarak, “olduğu gibi” ve “mevcut haliyle” sunulur. Uygulamanın, programların, hareket talimatlarının ve ölçümlerin doğru, eksiksiz, güncel, kesintisiz, hatasız veya belirli bir amaca (kas kazanımı, kilo verme, performans vb.) uygun olduğu ya da belirli bir sonuç sağlayacağı konusunda açık veya örtülü hiçbir garanti vermeyiz. Bu bölüm, tüketici mevzuatından doğan ve sözleşmeyle kaldırılamayan haklarını ortadan kaldırmaz.

Uygulamayı istediğin zaman kullanmayı bırakıp silebilirsin. Bu Koşulları ihlal edersen lisansın kendiliğinden sona erer. Uygulamanın dağıtımını durdurabiliriz; bu durumda cihazındaki veriler sende kalır.

13. Koşullardaki değişiklikler

Bu Koşulları güncelleyebiliriz; güncel metin bu sayfada yayımlanır. Esaslı değişikliklerde uygulama içinde yeniden onayın istenir; onaylamazsan Uygulamayı kullanmayı bırakabilirsin.

14. Uygulanacak hukuk ve uyuşmazlıklar

Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir. Tüketici sıfatıyla; uyuşmazlıklarda, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ilgili mevzuatta belirlenen parasal sınırlar dahilinde yerleşim yerindeki veya işlemin yapıldığı yerdeki tüketici hakem heyetlerine, bu sınırları aşan uyuşmazlıklarda tüketici mahkemelerine başvurabilirsin. Önce bize e-postayla ulaşmanı rica ederiz; çoğu sorunu hızla çözebiliriz.

1. Parties and acceptance

These Terms are an agreement between Mehmet Mutlu (individual developer, Üsküdar / Istanbul, Türkiye; “FORMA”, “we”) and you regarding the FORMA iPhone and Apple Watch apps and related web pages (the “App”). At first launch you must accept these Terms and the Health & Responsibility Notice, which forms part of them; the App cannot be used without acceptance. The date and version of your acceptance are stored only on your device. See also the Privacy Policy.

2. The App

FORMA provides a built-in programme library, workout and set tracking, rest timer, animated exercise library, Pilates, an Apple Watch app, steps and activity from Apple Health, weight log, points, badges and levels, local reminders and data export/import. It needs no account and works on your device without connecting to a server. Points, badges and levels have no monetary value and are not transferable. We may change, add or remove features.

3. Price

The App is currently free, with no ads, subscriptions or in-app purchases. Any future paid feature would be introduced only by updating these Terms and informing you clearly before purchase.

4. Eligibility

The App is for people aged 14 and over; users under 18 may use it only with the consent and supervision of a parent or guardian.

5. Programmes and health notice

Programmes are pre-made general suggestions, written with coaching rules and AI assistance and checked by rules in code. They are selected from the built-in library based on the information you enter; they are not prepared for you personally by an expert or an AI service and are not personal medical or coaching advice. The Health & Responsibility Notice is part of these Terms.

6. Acceptable use

Use the App only for lawful, personal purposes. Do not reverse engineer, decompile, modify, circumvent security, bulk-copy content (figures, animations, programmes, exercise texts) or distribute it commercially, except where mandatory law permits.

7. Your data

Your data belongs to you and stays on your device. Because we hold no copy, you are responsible for backups (iCloud backup or exported file); we cannot recover data after device loss, deleting the App or using “Delete my data”.

8. Apple Health and Apple Watch

Apple Health integration works only with your permission and is subject to Apple's terms. Steps, distance, calories and heart rate are device readings or estimates and must not be used for medical purposes.

9. Intellectual property and licence

The App, software, designs, figures and animations, programmes, exercise instruction texts, the “FORMA” name and logo belong to us or our licensors. We grant you a non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App for personal purposes on devices you own or control, subject to these Terms and the applicable store usage rules. You may not copy, reproduce, rent, sell, distribute or create derivative works. Open-source components and fonts are subject to their own licences, listed in the app.

10. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided free of charge, “as is” and “as available”, without express or implied warranties of accuracy, completeness, availability, freedom from errors, fitness for a particular purpose or results. Mandatory consumer rights are not affected.

11. Limitation of liability

Responsibility relating to exercise risks is governed by the Health & Responsibility Notice. To the fullest extent permitted by law, we are not liable for indirect damages, loss of profit or loss of data stored on your device. Nothing in these Terms excludes or limits liability that cannot be limited by law, including liability for intent or gross negligence, death or personal injury where not limitable, or your rights under mandatory consumer law.

12. Termination

You may stop using and delete the App at any time. Your licence ends automatically if you breach these Terms. If we stop distributing the App, your on-device data remains with you.

13. Changes

We may update these Terms; the current version is published here. For material changes we will ask you to accept again in the App.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. As a consumer you may apply to the consumer arbitration committees within the monetary limits set under Law No. 6502, and to consumer courts above them, at your place of residence or where the transaction was made. Please contact us first.

15. Apple-specific terms

If you obtained the App from the Apple App Store: (a) these Terms are between you and FORMA only, not Apple, and FORMA, not Apple, is solely responsible for the App and its content; (b) the licence is limited to use on Apple-branded products you own or control as permitted by the Usage Rules in the App Store Terms of Service; (c) Apple has no obligation to provide maintenance or support; (d) if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation, and any other claims attributable to a failure to conform to a warranty are FORMA's responsibility under these Terms; (e) FORMA, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims; (f) you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country and are not on any U.S. Government list of prohibited or restricted parties; (g) you must comply with applicable third-party terms when using the App; (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce them against you as a third-party beneficiary.

16. General and contact

If any provision is held invalid, the rest remain in effect. Failure to enforce a right is not a waiver. These Terms, together with the Health & Responsibility Notice and Privacy Policy, are the entire agreement. Contact: apps.support.mm@gmail.com.

1. Parteien und Annahme

Diese Bedingungen sind eine Vereinbarung zwischen Mehmet Mutlu (Einzelentwickler, Üsküdar / Istanbul, Türkei; „FORMA“, „wir“) und dir über die FORMA-Apps für iPhone und Apple Watch sowie die zugehörigen Webseiten (die „App“). Beim ersten Start musst du diese Bedingungen und den Gesundheits- und Verantwortungshinweis, der Bestandteil dieser Bedingungen ist, annehmen; ohne Annahme kann die App nicht genutzt werden. Datum und Version deiner Annahme werden ausschließlich auf deinem Gerät gespeichert. Siehe auch die Datenschutzerklärung.

2. Die App

FORMA bietet eine integrierte Programmbibliothek, Trainings- und Satzerfassung, einen Pausentimer, eine animierte Übungsbibliothek, Pilates, eine Apple-Watch-App, Schritte und Aktivität aus Apple Health, ein Gewichtsprotokoll, Punkte, Abzeichen und Level, lokale Erinnerungen sowie Datenexport und -import. Die App benötigt kein Konto und funktioniert auf deinem Gerät, ohne sich mit einem Server zu verbinden. Punkte, Abzeichen und Level haben keinen Geldwert und sind nicht übertragbar. Wir können Funktionen ändern, hinzufügen oder entfernen.

3. Preis

Die App ist derzeit kostenlos – ohne Werbung, Abonnements oder In-App-Käufe. Eine künftige kostenpflichtige Funktion würde nur durch Aktualisierung dieser Bedingungen und nach klarer Information vor dem Kauf eingeführt.

4. Nutzungsberechtigung

Die App richtet sich an Personen ab 14 Jahren; Nutzer unter 18 Jahren dürfen sie nur mit Zustimmung und unter Aufsicht eines Elternteils oder Erziehungsberechtigten verwenden.

5. Programme und Gesundheitshinweis

Die Programme sind vorgefertigte allgemeine Vorschläge, die anhand von Trainerregeln und mit KI-Unterstützung erstellt und durch Regeln im Code geprüft wurden. Sie werden anhand der von dir eingegebenen Angaben aus der integrierten Bibliothek ausgewählt; sie werden nicht von einer Fachperson oder einem KI-Dienst persönlich für dich erstellt und sind keine persönliche medizinische oder trainingsbezogene Beratung. Der Gesundheits- und Verantwortungshinweis ist Bestandteil dieser Bedingungen.

6. Zulässige Nutzung

Nutze die App nur für rechtmäßige, persönliche Zwecke. Du darfst die App nicht zurückentwickeln (Reverse Engineering), dekompilieren, verändern, Sicherheitsmaßnahmen umgehen, Inhalte (Abbildungen, Animationen, Programme, Übungstexte) massenhaft kopieren oder gewerblich verbreiten, soweit zwingendes Recht dies nicht erlaubt.

7. Deine Daten

Deine Daten gehören dir und verbleiben auf deinem Gerät. Da wir keine Kopie besitzen, bist du für Sicherungen (iCloud-Backup oder exportierte Datei) verantwortlich; nach Verlust des Geräts, Löschen der App oder Verwendung von „Meine Daten löschen“ können wir keine Daten wiederherstellen.

8. Apple Health und Apple Watch

Die Apple-Health-Integration funktioniert nur mit deiner Erlaubnis und unterliegt den Bedingungen von Apple. Schritte, Distanz, Kalorien und Herzfrequenz sind Gerätemesswerte oder Schätzungen und dürfen nicht für medizinische Zwecke verwendet werden.

9. Geistiges Eigentum und Lizenz

Die App, die Software, Designs, Abbildungen und Animationen, Programme, Übungsanleitungstexte sowie der Name und das Logo „FORMA“ gehören uns oder unseren Lizenzgebern. Wir räumen dir eine nicht ausschließliche, nicht übertragbare, nicht unterlizenzierbare, widerrufliche Lizenz ein, die App für persönliche Zwecke auf Geräten zu nutzen, die dir gehören oder deiner Kontrolle unterliegen, vorbehaltlich dieser Bedingungen und der geltenden Nutzungsregeln des Stores. Du darfst die App nicht kopieren, vervielfältigen, vermieten, verkaufen, verbreiten oder abgeleitete Werke erstellen. Open-Source-Komponenten und Schriftarten unterliegen ihren eigenen Lizenzen, die in der App aufgeführt sind.

10. Gewährleistungsausschluss

Soweit gesetzlich in vollem Umfang zulässig, wird die App kostenlos, „wie besehen“ und „wie verfügbar“ bereitgestellt, ohne ausdrückliche oder stillschweigende Gewährleistung für Richtigkeit, Vollständigkeit, Verfügbarkeit, Fehlerfreiheit, Eignung für einen bestimmten Zweck oder Ergebnisse. Zwingende Verbraucherrechte bleiben unberührt.

11. Haftungsbeschränkung

Die Verantwortung im Zusammenhang mit Trainingsrisiken richtet sich nach dem Gesundheits- und Verantwortungshinweis. Soweit gesetzlich in vollem Umfang zulässig, haften wir nicht für mittelbare Schäden, entgangenen Gewinn oder den Verlust von auf deinem Gerät gespeicherten Daten. Nichts in diesen Bedingungen schließt eine Haftung aus oder beschränkt sie, die gesetzlich nicht beschränkt werden kann, einschließlich der Haftung für Vorsatz oder grobe Fahrlässigkeit, für Tod oder Körperverletzung, soweit nicht beschränkbar, oder deiner Rechte nach zwingendem Verbraucherrecht.

12. Beendigung

Du kannst die Nutzung der App jederzeit beenden und sie löschen. Deine Lizenz endet automatisch, wenn du gegen diese Bedingungen verstößt. Wenn wir den Vertrieb der App einstellen, verbleiben deine Daten auf deinem Gerät bei dir.

13. Änderungen

Wir können diese Bedingungen aktualisieren; die jeweils aktuelle Version wird hier veröffentlicht. Bei wesentlichen Änderungen bitten wir dich in der App um erneute Annahme.

14. Anwendbares Recht und Streitigkeiten

Diese Bedingungen unterliegen dem Recht der Republik Türkei. Als Verbraucher kannst du dich innerhalb der nach dem Gesetz Nr. 6502 festgelegten Wertgrenzen an die Verbraucherschiedsausschüsse (tüketici hakem heyetleri) und oberhalb dieser Grenzen an die Verbrauchergerichte (tüketici mahkemeleri) an deinem Wohnsitz oder am Ort des Rechtsgeschäfts wenden. Bitte kontaktiere uns zuerst.

15. Besondere Bedingungen für Apple

Wenn du die App aus dem Apple App Store bezogen hast: (a) Diese Bedingungen gelten ausschließlich zwischen dir und FORMA, nicht Apple, und allein FORMA, nicht Apple, ist für die App und ihre Inhalte verantwortlich; (b) die Lizenz ist auf die Nutzung auf Produkten der Marke Apple beschränkt, die dir gehören oder deiner Kontrolle unterliegen, wie in den Nutzungsregeln der Nutzungsbedingungen des App Store gestattet; (c) Apple ist nicht verpflichtet, Wartungs- oder Supportleistungen zu erbringen; (d) wenn die App einer anwendbaren Gewährleistung nicht entspricht, kannst du Apple benachrichtigen, und Apple erstattet dir den Kaufpreis (falls vorhanden); soweit gesetzlich in vollem Umfang zulässig, hat Apple keine weitere Gewährleistungspflicht, und alle anderen Ansprüche, die auf die Nichterfüllung einer Gewährleistung zurückzuführen sind, liegen nach diesen Bedingungen in der Verantwortung von FORMA; (e) FORMA, nicht Apple, ist für die Bearbeitung aller Ansprüche im Zusammenhang mit der App verantwortlich, einschließlich Ansprüchen aus Produkthaftung, wegen Nichteinhaltung gesetzlicher oder behördlicher Vorschriften, aus Verbraucherschutz sowie wegen Verletzung geistigen Eigentums; (f) du sicherst zu, dass du dich nicht in einem Land befindest, das einem Embargo der US-Regierung unterliegt oder von der US-Regierung als „terroristenunterstützendes“ Land eingestuft wurde, und dass du nicht auf einer Liste der US-Regierung über verbotene oder eingeschränkte Parteien geführt wirst; (g) du musst bei der Nutzung der App die anwendbaren Bedingungen Dritter einhalten; (h) Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen, und mit deiner Annahme erhält Apple das Recht, diese Bedingungen dir gegenüber als Drittbegünstigter durchzusetzen.

16. Allgemeines und Kontakt

Sollte eine Bestimmung für unwirksam erklärt werden, bleiben die übrigen Bestimmungen wirksam. Die Nichtdurchsetzung eines Rechts stellt keinen Verzicht dar. 1. Parties et acceptation

Les présentes Conditions constituent un accord entre Mehmet Mutlu (développeur indépendant, Üsküdar / Istanbul, Turquie ; « FORMA », « nous ») et toi concernant les applications FORMA pour iPhone et Apple Watch et les pages web associées (l’« Application »). Au premier lancement, tu dois accepter les présentes Conditions ainsi que l’Avis santé et responsabilité, qui en fait partie intégrante ; l’Application ne peut pas être utilisée sans cette acceptation. La date et la version de ton acceptation sont enregistrées uniquement sur ton appareil. Voir aussi la Politique de confidentialité.

2. L’Application

FORMA propose une bibliothèque de programmes intégrée, le suivi des séances et des séries, un minuteur de repos, une bibliothèque d’exercices animés, du Pilates, une application Apple Watch, les pas et l’activité issus d’Apple Santé, un journal du poids, des points, badges et niveaux, des rappels locaux ainsi que l’export et l’import de données. Elle ne nécessite aucun compte et fonctionne sur ton appareil sans se connecter à un serveur. Les points, badges et niveaux n’ont aucune valeur monétaire et ne sont pas transférables. Nous pouvons modifier, ajouter ou supprimer des fonctionnalités.

3. Prix

L’Application est actuellement gratuite, sans publicité, abonnement ni achat intégré. Toute future fonctionnalité payante ne serait introduite qu’en mettant à jour les présentes Conditions et en t’informant clairement avant l’achat.

4. Conditions d’accès

L’Application est destinée aux personnes âgées de 14 ans et plus ; les utilisateurs de moins de 18 ans ne peuvent l’utiliser qu’avec le consentement et sous la surveillance d’un parent ou d’un tuteur légal.

5. Programmes et avis santé

Les programmes sont des suggestions générales préétablies, rédigées selon des règles de coaching avec l’aide de l’IA et vérifiées par des règles dans le code. Ils sont sélectionnés dans la bibliothèque intégrée en fonction des informations que tu saisis ; ils ne sont pas préparés pour toi personnellement par un expert ou par un service d’IA et ne constituent pas un conseil médical ou de coaching personnalisé. L’Avis santé et responsabilité fait partie des présentes Conditions.

6. Utilisation autorisée

Utilise l’Application uniquement à des fins licites et personnelles. Il est interdit de procéder à de l’ingénierie inverse, de décompiler, de modifier l’Application, d’en contourner la sécurité, d’en copier massivement le contenu (illustrations, animations, programmes, textes d’exercices) ou de le distribuer à des fins commerciales, sauf dans la mesure où la loi impérative le permet.

7. Tes données

Tes données t’appartiennent et restent sur ton appareil. Comme nous n’en détenons aucune copie, tu es responsable de tes sauvegardes (sauvegarde iCloud ou fichier exporté) ; nous ne pouvons pas récupérer de données après la perte de l’appareil, la suppression de l’Application ou l’utilisation de « Supprimer mes données ».

8. Apple Santé et Apple Watch

L’intégration avec Apple Santé ne fonctionne qu’avec ton autorisation et est soumise aux conditions d’Apple. Les pas, la distance, les calories et la fréquence cardiaque sont des mesures ou des estimations de l’appareil et ne doivent pas être utilisés à des fins médicales.

9. Propriété intellectuelle et licence

L’Application, le logiciel, les designs, les illustrations et animations, les programmes, les textes d’instructions des exercices ainsi que le nom et le logo « FORMA » nous appartiennent ou appartiennent à nos concédants de licence. Nous t’accordons une licence non exclusive, non transférable, ne pouvant faire l’objet d’une sous-licence et révocable pour utiliser l’Application à des fins personnelles sur des appareils que tu possèdes ou contrôles, sous réserve des présentes Conditions et des règles d’utilisation applicables de la boutique. Tu ne peux pas copier, reproduire, louer, vendre, distribuer l’Application ni créer d’œuvres dérivées. Les composants open source et les polices de caractères sont soumis à leurs propres licences, répertoriées dans l’Application.

10. Exclusion de garanties

Dans toute la mesure permise par la loi, l’Application est fournie gratuitement, « en l’état » et « selon disponibilité », sans garantie expresse ou implicite d’exactitude, d’exhaustivité, de disponibilité, d’absence d’erreurs, d’adéquation à un usage particulier ou de résultats. Les droits impératifs des consommateurs ne sont pas affectés.

11. Limitation de responsabilité

La responsabilité liée aux risques de l’exercice physique est régie par l’Avis santé et responsabilité. Dans toute la mesure permise par la loi, nous ne sommes pas responsables des dommages indirects, du manque à gagner ou de la perte de données stockées sur ton appareil. Aucune disposition des présentes Conditions n’exclut ni ne limite une responsabilité qui ne peut être limitée par la loi, y compris la responsabilité pour faute intentionnelle ou faute lourde, pour décès ou dommages corporels lorsqu’elle ne peut être limitée, ni tes droits au titre du droit impératif de la consommation.

12. Résiliation

Tu peux cesser d’utiliser l’Application et la supprimer à tout moment. Ta licence prend fin automatiquement si tu enfreins les présentes Conditions. Si nous cessons de distribuer l’Application, les données présentes sur ton appareil restent en ta possession.

13. Modifications

14. Droit applicable et litiges

Les présentes Conditions sont régies par le droit de la République de Turquie. En tant que consommateur, tu peux saisir les commissions arbitrales de la consommation (tüketici hakem heyetleri) dans les limites de montant fixées en application de la loi n° 6502 et, au-delà de ces limites, les tribunaux de la consommation (tüketici mahkemeleri), au lieu de ton domicile ou du lieu où la transaction a été effectuée. 15. Conditions spécifiques à Apple

Si tu as obtenu l’Application sur l’App Store d’Apple : (a) les présentes Conditions sont conclues uniquement entre toi et FORMA, et non avec Apple, et FORMA, et non Apple, est seul responsable de l’Application et de son contenu ; (b) la licence est limitée à une utilisation sur des produits de marque Apple que tu possèdes ou contrôles, dans les conditions prévues par les Règles d’utilisation des Conditions générales de l’App Store ; (c) Apple n’a aucune obligation de fournir des services de maintenance ou d’assistance ; (d) si l’Application n’est pas conforme à une garantie applicable, tu peux en informer Apple, et Apple te remboursera le prix d’achat (le cas échéant) ; dans toute la mesure permise par la loi, Apple n’a aucune autre obligation de garantie, et toute autre réclamation imputable à un défaut de conformité à une garantie relève de la responsabilité de FORMA au titre des présentes Conditions ; (e) FORMA, et non Apple, est responsable du traitement de toute réclamation relative à l’Application, y compris les réclamations en matière de responsabilité du fait des produits, de conformité légale ou réglementaire, de protection des consommateurs et de contrefaçon de propriété intellectuelle ; (f) tu déclares que tu ne te trouves pas dans un pays soumis à un embargo du gouvernement des États-Unis ou désigné par celui-ci comme pays « soutenant le terrorisme », et que tu ne figures sur aucune liste du gouvernement des États-Unis de parties interdites ou soumises à restrictions ; (g) tu dois respecter les conditions applicables des tiers lorsque tu utilises l’Application ; (h) Apple et ses filiales sont des tiers bénéficiaires des présentes Conditions et, dès ton acceptation, Apple aura le droit de les faire appliquer à ton encontre en qualité de tiers bénéficiaire.

16. Dispositions générales et contact

Si une disposition est déclarée invalide, les autres restent en vigueur. Le fait de ne pas exercer un droit ne vaut pas renonciation à celui-ci.
